These Terms and Conditions (“Terms”) govern the provision of housing modification and related services by LIVEABLE Limited (“LIVEABLE”, “we”, “our”, “us”) to its clients (“Client”, “you”, “your”). By engaging LIVEABLE, you agree to be bound by these Terms.
1.1 LIVEABLE provides design, consultation, project management, and housing modification services to improve accessibility, safety, and independence.
1.2 The specific services to be provided will be outlined in a written proposal or service agreement.
2.1 The Client must provide accurate and complete information regarding their needs, property, and health or mobility requirements.
2.2 The Client is responsible for obtaining all necessary permissions, consents, or approvals required for works to proceed, unless otherwise agreed in writing.
2.3 The Client agrees to provide reasonable access to the property for assessments, works, and inspections.
3.1 All fees will be outlined in writing prior to work commencing.
3.2 Unless otherwise agreed, a deposit is required before commencement, with progress payments or final balance payable upon completion.
3.3 Payment terms are strictly [14] days from invoice date. Late payments may attract interest at [2%] per month.
4.1 Cancellations must be made in writing. Fees for work already completed or costs incurred will remain payable.
4.2 Any variations to agreed works must be documented in writing and may result in additional charges.
5.1 LIVEABLE complies with all relevant health and safety legislation.
5.2 Clients must notify LIVEABLE of any hazards on site.
5.3 Clients agree not to interfere with or endanger the safety of contractors or works being undertaken.
6.1 LIVEABLE warrants that services will be carried out with reasonable skill and care.

6.3 Liability for defective services is limited, at LIVEABLE’s discretion, to rectification, replacement, or refund of fees paid.
7.1 ICONIC Homes (building supplier for LIVEABLE) maintains public liability insurance.
7.2 The Client is responsible for maintaining property and contents insurance.
8.1 LIVEABLE collects and handles personal information in accordance with its Privacy Policy.
8.2 All information provided by Clients will be treated confidentially unless disclosure is required by law.
9.1 Either party may terminate an engagement by written notice if the other party materially breaches these Terms.
9.2 Termination does not affect accrued rights or obligations.
10.1 These Terms are governed by the laws of New Zealand.
10.2 Any disputes shall be resolved in the first instance through good faith negotiation, and if unresolved, in the New Zealand courts.
